Welcome to Niemploy. These Terms and Conditions govern your access to and use of Niemploy’s website and all related services By creating an account or using Niemploy in any way, you agree to these Terms. If you do not agree, please stop using the Platform immediately.
About Niemploy
Niemploy is an online freelance marketplace designed to connect clients (individuals or businesses seeking services) with freelancers (individuals offering services).
We aim to provide a secure, accessible, and reliable platform where:

Clients can find skilled professionals across Africa and beyond.

Freelancers can showcase their talents, earn money, and grow their careers.
Niemploy provides only the platform — we do not employ freelancers, guarantee outcomes, or directly deliver any services.
Acceptance of Terms
By using Niemploy, you confirm that you:

Are at least 18 years old;

Have the legal capacity to enter into binding agreements;

Have read, understood, and accepted these Terms;

Will comply with all applicable local, national, and international laws.
If you are using Niemploy on behalf of a business or organization, you represent that you are authorized to bind that entity to these Terms.
Account Registration and Security
To use most features of Niemploy, you must create an account.
When registering:

Provide accurate, up-to-date information.

Keep your login credentials secure and confidential.

You are fully responsible for any actions taken under your account.
If we detect suspicious or fraudulent activity, we reserve the right to suspend or terminate your account without prior notice.
You may operate as both a client and a freelancer using the same account, but you must comply with the rules for each role.
Platform Usage Rules
You agree to use Niemploy responsibly and ethically.
Prohibited actions include (but are not limited to):

Posting illegal, defamatory, or harmful content.

Promoting scams, false services, or misleading claims.

Sharing personal data of others without consent.
-
Using the platform to harass, discriminate, or threaten others.
-
Circumventing fees by requesting or offering payment outside the platform.
-
Spamming, phishing, or engaging in unauthorized advertising.

Attempting to hack, damage, or exploit Niemploy’s systems.
We reserve the right to remove any content or suspend accounts that violate these guidelines.
Payments, Fees, and Commissions
All transactions between clients and freelancers occur within Niemploy.
This ensures fairness, transparency, and protection for both parties.

Freelancer Earnings: Freelancers receive 70% of each completed transaction. Niemploy retains 30%
-
Client Fees: Clients are charged a 2% transaction fee on payments made through the platform.

Payments: All payments are processed securely through third-party gateways such as Paystack or other approved providers.
Niemploy is not responsible for:
-
Delays caused by payment processors or banks,
-
Rejected or reversed transactions,
-
Losses due to incorrect payment details entered by users.
Freelancers are advised to ensure the accuracy of their withdrawal details before requesting payouts.
Withdrawal Policy
Freelancers can withdraw earnings once they become “available” in their balance (after a project is marked completed and the payment is cleared).
Withdrawals are:

Subject to minimum and maximum limits based on country and method.
-
Processed within a reasonable timeframe, though delays may occur due to third-party providers or verification steps.

Paid in the currency available on the platform (currently NGN – Naira).
Niemploy reserves the right to:
-
Delay withdrawals for verification or compliance checks.
-
Freeze funds in cases of disputes, refunds, or fraudulent activity.
-
Reject withdrawal requests that violate our Terms.
Job Delivery and Approval
Once a freelancer submits work:
-
The client has a set review period (usually 3–5 days) to approve or request revisions.
-
If the client fails to respond within this period, the job may be marked automatically completed.
-
Once completed, funds are released to the freelancer’s balance (after applicable fees).
Clients are encouraged to review submissions carefully before approving them, as approved jobs cannot be reversed without a dispute review.
Disputes and Resolution
Disputes should first be resolved amicably between the freelancer and client through the chat system.
If that fails:

Either party can open a dispute case through the platform.

Niemploy’s moderation team will review the case based on available evidence.
-
Our decision is final and binding within the platform’s scope.
Niemploy is not legally obligated to resolve every conflict, refund payment, or enforce performance but will act fairly based on evidence and platform rules.
Refund Policy
Refunds may be approved if:

The freelancer fails to deliver within the agreed time, or
-
The delivered work clearly violates the project’s agreed scope.
Refunds will not be granted for:
-
Change of mind by the client after delivery,
-
Approved or downloaded work,
-
Payments made outside Niemploy.
All refunds are processed back to the client’s Niemploy balance and may be subject to transaction fees.
Intellectual Property Rights

Freelancers retain ownership of all original work until full payment is received.

Upon payment, clients receive the agreed rights to use the delivered work
-
Niemploy may display samples or thumbnails of work for promotional purposes
Users must not upload or sell copyrighted materials they don’t own. Niemploy complies with takedown requests for verified copyright violations.
Platform Rights and Ownership
All content, features, software, and materials on Niemploy (excluding user submissions) are owned by Niemploy and protected by copyright, trademark, and intellectual property laws.
You may not copy, modify, reverse-engineer, or resell any part of Niemploy without written permission.
Account Termination
We reserve the right to suspend, restrict, or permanently terminate accounts that:

Violate these Terms,

Engage in fraud or abuse, or
-
Harm other users or the platform’s integrity.
You may close your account at any time
Upon closure, any pending withdrawals or balances may be reviewed for compliance before release.
Limitation of Liability
Niemploy provides the platform “as is” and “as available.”
We make no warranties, express or implied, about:

The accuracy or reliability of content,
-
Continuous availability of services,
-
The actions of users or third parties.
To the fullest extent permitted by law, Niemploy will not be liable for:

Lost profits, revenues, or data,
-
Business interruptions,
-
Indirect, incidental, or consequential damages.
Your use of Niemploy is entirely at your own risk.
Indemnification
You agree to defend, indemnify, and hold Niemploy, its founders, employees, and affiliates harmless from any claims, damages, or expenses arising from:

Your use of the platform,

Violation of these Terms,

Misuse of intellectual property, or
-
Disputes between you and another user.
Privacy
Your use of Niemploy is also governed by our Privacy Policy, which explains how we collect and protect your data.

Updates to the Terms
We may update these Terms occasionally to reflect new features, laws, or improvements.
When we do, we’ll post a new version on this page and update the “Last Updated” date above.
Your continued use of Niemploy means you accept any changes.
Governing Law
These Terms are governed by the laws of the Federal Republic of Nigeria.
Any legal actions arising under these Terms shall be handled in Nigerian courts.
